  • Medical Marijuana Bill moves forward in North Carolina Senate

    Senate Bill 3, the NC Compassionate Care Act The North Carolina Compassionate Care Act, which was struck down last year, is showing promise during its new 2023 round. As of February 28, 2023, Senate Bill 3 passed two readings by North Carolina's Senate committee and it will undergo a third reading next week. Governor Roy Cooper is likely to sign the bill if it reaches his desk, based on an interview he had with WXII 12 News in December 2022. What is Senate Bill 3? If passed, the bill would grant access to medical marijuana for individuals dealing with cancer and post-traumatic stress disorder (PTSD). Patients would have to apply for a card and, once approved, would be able to purchase from licensed suppliers. The state plans to grant 10 licenses, and each holder could have up to 8 dispensaries. North Carolina is one of the few states in the country that have yet to pass a medical marijuana bill. Will it Pass the House? If Senate Bill passes its third reading, it will go to the House to be voted on. Last year, this is where the bill, unfortunately, did not make it through. However, those following the bill's progress remain optimistic this time around. The bill would establish a Compassionate Use Advisory Board, to review whether conditions will be added to the bill. If it passes the House, it will head to Gov. Roy Cooper to sign into law.

CBD is one of the many compounds found in the Cannabis sativa plant, commonly known as hemp. Unlike tetrahydrocannabinol (THC), CBD is not psychoactive and does not cause the "high" associated with marijuana use. This has led to a surge in demand for CBD products, but many people wonder if CBD works without THC. Do CBD Products Still Work Without THC? The short answer is yes, CBD can work without THC. In fact, many CBD products are made with little to no THC. CBD works by interacting with the body's endocannabinoid system (ECS), which is responsible for regulating a wide range of physiological processes such as mood, appetite, pain, and inflammation. The ECS consists of cannabinoid receptors, endocannabinoids (naturally occurring compounds in the body that bind to these receptors), and enzymes that break down these compounds. CBD interacts with the ECS by inhibiting the enzymes that break down endocannabinoids, leading to increased levels of these compounds in the body. This, in turn, can have a wide range of therapeutic effects. That being said, there is some evidence to suggest that CBD may work better in the presence of THC. This is known as the entourage effect, which suggests that the various compounds in the cannabis plant work together synergistically to produce enhanced therapeutic effects. While THC is not necessary for CBD to be effective, some people may find that a combination of the two produces better results. The Differences Between Full and Broad Spectrum When it comes to CBD products, there are two main types: full spectrum and broad spectrum. Full spectrum CBD contains all of the compounds found in the cannabis plant, including THC, other cannabinoids, and terpenes. Broad spectrum CBD, on the other hand, contains all of the compounds found in the plant except for THC. The main difference between full spectrum and broad spectrum CBD is the presence of THC. While full spectrum CBD may provide enhanced therapeutic effects due to the entourage effect, it may not be suitable for everyone, especially those who are sensitive to THC or subject to drug testing. Broad spectrum CBD, which contains all of the other compounds found in the plant without the THC, may be a better option for those who want to avoid THC or find THC-free products more effective. Which CBD is Right for You? In conclusion, CBD can work without THC, but the presence of THC may enhance its therapeutic effects. When choosing a CBD product, it's important to consider whether you want the potential benefits of the entourage effect or if you want to avoid THC altogether. Full spectrum CBD products have the potential to be more effective, but broad spectrum CBD products may be a safer option for those who are sensitive to THC or subject to drug testing.

  • DEA States Delta-8 and -9 THCO are Schedule 1 Controlled Substances

    THC-O is Federally Illegal as a Schedule 1 Controlled Substance As of February 2023, the United States Drug Enforcement Administration (DEA) has added delta-8 THCO (delta-8-THC acetate ester) and delta-9 THCO (delta-9-THC acetate ester) to the Schedule 1 list for controlled substances. The DEA regulates the distribution of substances with a potential for abuse and dependence, and Schedule 1 is the most restrictive category of controlled substances. This means that any company selling products containing these cannabinoids must immediately cease sales. Last year, North Carolina cannabis attorney Rod Kight inquired with the DEA on their stance with THCO’s legality. In response, the letter states “Delta-9-THCO and delta-8-THCO do not occur naturally in the cannabis plant and can only be obtained synthetically, and therefore do not fall under the definition of hemp”. Furthermore, Terrence L. Boos, Chief Drug & Chemical Evaluation Section, continued that “delta-9-THCO and delta-8-THCO meet the definition of “tetrahydrocannabinols,” and they… are controlled in schedule I by 21 U.S.C. § 812(c) Schedule I, and 21 CFR § 1308.11(d). Kight’s original email and the DEA’s response can be read here. How is THC-O Different from Other Naturally Occurring Cannabinoids? There are over 60 naturally occurring cannabinoids found in the cannabis plant, with the most commonly discussed being THC and CBD. On the other hand, Delta-8 THCO and Delta-9 THCO must be converted from other cannabinoids, which means they do not fall under the definition of hemp as they are not naturally occurring. Inhalation Safety Concerns There is a particular concern related to the manufacturing process of THC-O products. One of the most common methods of synthesizing THC-O involves using a chemical called acetic anhydride. Recently, a study published in the Journal of Medical Toxicology suggests there are potential safety concerns regarding THC-O inhalation. When THC-O acetate is vaporized and inhaled, it can condense into a harmful substance called acetic acid in the lungs. Acetic acid is highly corrosive and can cause severe damage to the lungs. This risk is compounded by the fact that these synthetic cannabinoids are often added to e-liquids and vape cartridges, which can be easily consumed by individuals who may not be aware of the risks. These risks, combined with the fact that Delta-8 THCO and Delta-9 THCO do not occur naturally in hemp, make their addition to the Schedule 1 list of controlled substances an important development for the cannabis industry. It underscores the need for strict regulation and oversight of products containing these substances. The Future of THC-O Companies that continue to sell Delta-8 THCO and Delta-9 THCO products risk facing legal consequences, as the DEA takes a strong stance on the distribution of controlled substances. The DEA has also indicated that it will be closely monitoring the manufacture, distribution, and marketing of these products in the coming months. In summary, the addition of Delta-8 THCO and Delta-9 THCO to the Schedule 1 list of controlled substances is a significant development for the cannabis industry. Companies must cease the sale of these products immediately, and consumers should exercise caution when using any products containing these cannabinoids.
